Hitster Social Media Giveaway Terms & Conditions

1. Promoter

These giveaway terms and conditions (“Terms”) apply to promotional giveaways, contests and competitions (“Giveaways”) organised by Jumbo Group B.V. (“Jumbo”). Each Giveaway is subject to these Terms together with the specific details stated in the applicable social media post promoting the Giveaway (“Campaign Post”). By entering a Giveaway, participants agree to be bound by these Terms and the details stated in the relevant Campaign Post.

2. Eligibility

Unless otherwise stated in the applicable Campaign Post:

  • entrants must be at least 18 years old;
  • entrants must be legal residents of countries where Hitster products are officially distributed and where participation is lawful;
  • employees, contractors, agents, distributors and immediate family members of Jumbo or affiliated companies may not enter.

Participation is void where prohibited or restricted by applicable law. Jumbo reserves the right to verify eligibility and request proof of identity, age and residency.

3. Promotion Period

The opening date, closing date and applicable time zone for each Giveaway will be stated in the relevant Campaign Post. Entries received outside the stated promotion period will not be valid.

4. How to Enter

The applicable entry method will be described in the relevant Campaign Post.

Entry mechanics may include:

  • commenting on a post;
  • following a social media account;
  • liking or sharing content;
  • submitting user-generated content (“UGC”);
  • answering quiz or skill-based questions;
  • participating in instant win or first-entry mechanics.

Unless otherwise stated:

  • no purchase is necessary;
  • internet access and a valid social media account are required;
  • entries must comply with these Terms and the rules of the applicable platform.

Jumbo may disqualify incomplete, fraudulent, automated, misleading or abusive entries.

5. Entry Limits

Any entry limits applicable to a Giveaway will be stated in the relevant Campaign Post.

Unless otherwise stated:

  • one entry per person and per social media account applies;
  • entrants may not use multiple accounts, aliases, bots or automated methods.

6. Prizes

The prize(s), approximate retail value (if applicable), number of winners and any applicable restrictions will be stated in the relevant Campaign Post.

Prizes are non-transferable, may not be exchanged for cash unless required by law, and may be substituted by Jumbo with a prize of equal or greater value where reasonably necessary.

Jumbo is not responsible for:

  • lost, delayed or damaged shipments;
  • customs duties, taxes or import charges;
  • inability to deliver prizes due to local restrictions.

Jumbo reserves the right to refuse shipment of prizes to jurisdictions where fulfilment is impractical, prohibited or disproportionately burdensome.

7. Winner Selection

The winner selection method for each Giveaway will be stated in the applicable Campaign Post.

Depending on the Giveaway mechanic, winners may be selected:

  • randomly from eligible entries;
  • based on skill, creativity or judging criteria;
  • based on correct answers;
  • based on order of participation (e.g. first valid entries received).

Where winners are selected by random draw, the draw will be conducted fairly from all eligible entries received. Jumbo’s decision is final unless otherwise required by law.

8. Winner Notification

Winners may be contacted via direct message, public comment, reply on the relevant platform, or through other contact details provided by the entrant. If a winner cannot be contacted, does not respond within the stated timeframe or is found ineligible, Jumbo may select an alternative winner.

9. User-Generated Content (UGC)

Where a Giveaway involves submission of photos, videos, captions, stories or other content:

The entrant confirms that:

  • they own or control all rights in the submitted content;
  • the content does not infringe third-party rights;
  • any identifiable persons appearing in the content have consented to its use;
  • the content is lawful and appropriate.

By entering, entrants grant Jumbo a non-exclusive, worldwide, royalty-free, non-exclusive, worldwide, royalty-free, sublicensable and transferable licence to use, reproduce, repost, edit, publish, adapt and display the submitted content in connection with marketing, promotional and social media activities across all media channels. This license is granted for the duration of applicable intellectual property rights unless prohibited by law.

10. Prohibited Content

Entries must not contain content that:

  • is unlawful, defamatory, offensive or discriminatory;
  • promotes violence, hate or illegal activity;
  • infringes intellectual property or privacy rights;
  • contains viruses, malware or harmful code.

Jumbo reserves the right to remove or disqualify prohibited content.

11. Platform Disclaimer

This Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram or TikTok. By participating, entrants release Instagram and TikTok from any responsibility or liability related to the Giveaway. Entrants must comply with the applicable platform terms of use and community guidelines.

12. Limitation of Liability

To the maximum extent permitted by law, Jumbo shall not be liable for:

  • technical failures or platform interruptions;
  • lost, delayed or corrupted entries;
  • unauthorised intervention or fraud;
  • indirect or consequential damages;
  • failed prize delivery outside Jumbo’s reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded.

13. Privacy

Personal data collected in connection with a Giveaway will be processed in accordance with Jumbo’s Privacy Policy available at [Jumbo Group – Privacy policy]. Personal data may be used for administering the Giveaway, contacting winners, prize fulfilment, fraud prevention, and legal compliance. Winner information may be shared with logistics providers or fulfilment partners where necessary.

14. Publicity

Where permitted by law, winners may be asked to participate in reasonable publicity related to the Giveaway. Participation in publicity is voluntary unless local law provides otherwise.

15. Right to Modify or Cancel

Jumbo reserves the right to modify, suspend or cancel a Giveaway where necessary due to circumstances beyond its reasonable control, fraud, technical issues or legal/regulatory requirements.

16. Governing Law

These Terms shall be governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, unless mandatory consumer law provides otherwise.
